NORDIC SPIRIT PERFECT STORE TRADE COMPETITION 2022 TERMS AND CONDITIONS

  1. 1. The Promoter
  2. 1. The Promoter is: Gallaher Limited (JTI), Members Hill, Brooklands Road, Weybridge KT13 0QU.
  3. 2. The Competition
  4. 2.1 The title of the competition is 'Nordic Spirit Perfect Store Trade Competition 2022'.
  5. 2.2 Eligibility
  6. 2.3 The Competition is open to UK Independent store owners aged 18 and over meeting the Promoter's volume criteria as at the Regional Opening Date (Qualifying Stores).
  7. 2.4 The Competition is not open to employees of the Promoter and their families, agencies or their employees and families or anyone else professionally associated with the Competition.
  8. 2.5 In entering the Competition, you confirm that you are eligible to do so and eligible to claim any prize you may win. The Promoter may require you to provide proof that you are eligible to enter the Competition.
  9. 2.6 There is a limit of one entry to the Competition per store.
  10. 2.7 There is no fee to enter the Competition and no purchase necessary.
  11. 2.8 The Competition is run in two parts:

    1. (i) Regional Competition - open from 18 July 2022 (Regional Opening Date) to 2 December 2022 (Regional Closing Date). Participating stores will be measured and tracked on their performance against the JTI Nordic Spirit Perfect Store model (Model) further described in the accompanying competition booklet (Competition Booklet) by JTI sales representatives during usual JTI store visits. 10 stores with the highest number of points (Regional Winners) in each of the four JTI sales regions (Regions) - 40 stores in total - will win the Regional Prize Package and have a chance to enter the National Competition.
    2. (ii) National Competition - open from 3 January 2023 (National Opening Date) to 31 January 2023 (National Closing Date) to the Regional Winners. The Regional Winners will have a chance to win 1 out of 4 National Prize Packages and become 1 of the 4 Nordic Spirit Perfect Store National Champions (National Champions) - there will be 1 National Champion per Region.
  12. 3.   REGIONAL COMPETITION
  13. 3.1 Regional Competition Mechanic
  14. 3.2 To enter the Regional Competition, a Qualifying Store owner must allow a minimum of 3 visits by a JTI sales representative, however JTI will endeavour to conduct a visit each JTI sales cycle (approximately every 4 weeks) and score the Qualifying Store against the Nordic Spirit Perfect Store Model's key performance indicators (KPIs). There will be up to 100 KPI points available across 5 Model Pillars.
  15. 3.3 All JTI visits to the Qualifying Stores must take place between Regional Opening and Closing Dates. JTI sales visit outside of those dates do not count towards National Competition scores and are automatically disqualified.
  16. 3.4 Please see further details on the KPIs in the Competition Booklet available on JTI Advance and your local JTI sales representative.
  17. Regional Winners
  18. 3.5 After the Regional Closing Date, all Qualifying Stores will be ranked by their total Competition points. 10 stores with the highest average scores in each of the JTI Region will win one of the National Prize Packages - 40 in total - and become the Regional Winners. In the event stores score an equal number of total points, the Promoter reserves the right to select the Regional Winners by way of a random draw performed by a computer - by way of example - if within one region 2
  19. 3.6 The Regional Winners will be chosen and informed by email held on the Promoter's retailer database; and announced at JTI Advance and/or in trade press, by 31 December 2022 (Regional Announcement Date).
  20. Regional Prize Package
  21. 3.7 There are 40 National Prize Packages available for the value of up to £2000 (as further described below).
  22. 3.8 Each Regional Prize Package includes the following prizes:

    1. (i) one year's supply of Nordic Spirit: 52 x 5 can outers in total made up of the following: 5 x Mint Extra Strong, 10 x Mint Strong, 5 x Mint Regular, 10 X Bergamot Wildberry Extra Strong, 5 x Bergamot Wildberry Strong, 7 x Spearmint Extra Strong. The prize value of £1,690 based 52 outers of Nordic Spirit sold at £6.50 RRP - the stock will be delivered on a single date.
    2. (ii) £125 Gourmet Restaurant Voucher: voucher terms and conditions apply - go to https://www.gourmetguide.co.uk/ to find participating restaurants and the valid redemption period.
    3. (iii) Limited edition Nordic Spirit Perfect Store branded merchandise.
    4. (iv) Standard Nordic Spirit merchandise for store staff (up to 4 of each of the following items)

      1. (i) Bobble Hat
      2. (ii) Gloves
      3. (iii) Jacket
      4. (iv) Rucksack
      5. (v) Notebook & Pen
      6. (vi) Thermal Bottle
    5. (v) FitBit Versa 3 Smartwatch in the Black/Black Aluminium colour. The prize value based on the Promoter's purchase value of £170.
  23. 4.   NATIONAL COMPETITION
  24. 4.1 National Competition Mechanic
  25. 4.2 The National Competition is open to the 40 Regional Winners only.
  26. 4.3 To enter the National Competition:

    1. (i) send a completed entry form online by creating an online account on JTI Advance (if you do not already have one) by the National Closing Date. The Promoter will provide Regional Winners with a link to the entry form.
    2. (ii) the entry form requires entrants to including but not limited to:

      1. a. answer a series of short questions regarding their store's engagement and performance with the Nordic Spirit Perfect Store Model
      2. b. the impact the Perfect Store Model has had on the store's nicotine pouch category
      3. c. reasons why you think your store should win the National Competitions
      4. d. photos and examples of best practice of the Perfect Store Model retailing and execution.
    3. (iii) The entry form is subject to change prior to the National Opening Date.
  27. 4.4 All entries received after the National Closing Date are automatically disqualified.
  28. The National Champions
  29. 4.5 The Regional Winners will be chosen and informed by email held on the Promoter's sales database; and announced on JTI Advance and/or in trade press by 28 February 2023 (National Champion Announcement Date).
  30. 4.6 The National Competition entries will be judged by a panel of three judges based on the most apt and original answers to the questions. There will be 2 judges working for the Promoter and 1 independent judge.
  31. 4.7 4 National Champions will be chosen - 1 for each of the Regions.
  32. 4.8 The Promoter will send the full names of the judges to anyone who writes within one month after the National Closing Date requesting details of the judges by email to Clarion_jti@clarioncomms.co.uk.
  33. 4.9 National Competition entries cannot be returned.
  34. 4.10 The decision of the judges nominated by the Promoter is final and no correspondence or discussion will be entered into.
  35. 4.11 The Promoter will contact the National Champions personally as soon as practicable after the National Announcement Date, using the telephone number or email address held on the Promoter's sales database.
  36. The National Prize Package
  37. 4.12 There are 4 National Prize Packages available.
  38. 4.13 The Total value of the National Prize Package is up to £20,000 as further described below.
  39. 4.14 The National Prize Package includes:

    1. (i) A one off £2000 Wholesaler Credit

      1. (i) Retailer will be required to notify JTI of their selected wholesaler
      2. (ii) £2,000 will be credited to the retailer's wholesale account at that selected wholesale depot
      3. (iii) Can only be redeemed at one wholesaler depot in one transaction
      4. (iv) Redeemable against JTI tobacco, vape and nicotine pouch products only
      5. (v) Other manufacturers products will not be covered, and any shortfall in spend against JTI products during that transaction shall be forfeited
      6. (vi) £2,000 to be added to the winner's wholesale account on 1 March 2023 and must be redeemed within 90 days.
    2. (ii) A Nordic Spirit store makeover

      1. (i) JTI will provide a Nordic Spirit front of store makeover
      2. (ii) JTI and their suppliers will survey the store and agree the most effective makeover solutions as per the store's layout and advertising opportunity, to include but not limited to the following:

        1. (A) Store Fascia
        2. (B) Window Skins / Wraps
        3. (C) Canopy (if applicable)
        4. (D) Signage
        5. (E) Sundry items, including bins, Newspaper racks, parasols etc
        6. (F) Digital solutions
      3. This prize is subject to a further agreement to be signed by the National Champions. The Value of the Prize is up to £10,000 depending on the store makeover costs.
    3. (iii) 2 event or festival tickets

      1. (i) 2 x standard tickets to a selected event or festival in 2023 - subject to availability
      2. (ii) A list of available events/festivals will be given to the National Champions to choose from
      3. (iii) Bespoke requests outside of the available lists will not be accommodated
      4. (iv) Attendees of the event/festival must be 18 years or older
      5. (v) Travel and accommodation arrangements not included
      6. The value of the prize is dependant on the event attended.
    4. (iv) 1 Apple 10.9" iPad Air 2022 - 256GB, Space Grey

      1. (i) Prize will be delivered to store by your local JTI Representative. The value of the prize is £750.
    5. (v) 1 national trade press campaign

      1. (i) Trade press campaign to showcase the 4 x National Champions and their stores to be developed by a trade press agency appointed by the Promoter.
    6. (vi) 1 Accredited Perfect Store Trophy & Framed Certificate

      1. (i) Your local JTI representative will deliver to you an accredited Nordic Spirit Perfect Store winners trophy and a framed certificate
      2. (ii) The Nordic Spirit Perfect Store National Champion 2022 status.
    7. (vii) trip for two to Iceland

      1. (i) The holiday is provided by Cloud Nine Incentives, https://www.uponcloudnine.co.uk/
      2. (ii) The holiday is for two (2) to travel by a direct economy flight to Reykjavik for 3 nights to be used by 23 December 2023 (excluding bank holidays, Easter and Christmas holidays, as per the prize information provided by the Supplier).
      3. (iii) Direct flights only - excludes UK airports offering indirect flights.
      4. (iv) Return transfers in Iceland between the airport to the hotel.
      5. (v) Daily lunch and dinner allowance for the value of up to £600 in total for the trip.
      6. (vi) Includes three excursions on the dates to be confirmed by the Supplier:

        1. (A) Northern Lights Tour
        2. (B) Blue Lagoon Entry
        3. (C) Golden Circle & Glacier Snowmobiling
      7. (vii) ABTA or ATOL protection - Comprehensive travel insurance is included in the prize; however it does not cover pre-existing medical conditions. In the event that cover is not granted an equivalent cash allowance will be provided so that an adequate cover can be sought by the National Champions. This will be the prize winner's responsibility and the Supplier will require a proof of insurance prior to departure.
      8. (viii) Cloud Nine Winner Management - once the National Champions have been confirmed and contacted by the Promoter, the Supplier will contact them and manage the booking process and their experience.
      9. (ix) Other than the total lunch and dinner allowance of £600 referred to in condition 2.29. (vii) (v), the prize does not include the cost of transfers to and from the UK airports or stations, food and drink, spending money, tax or personal expenses. Any other costs incurred in addition to those set out above and that are incidental to the fulfilment of the prize are the responsibility of the winner(s).
      10. (x) You will be responsible for ensuring that you and any person travelling with you are available to travel and hold valid passports, any necessary visas and travel documents for the holiday in question on the travel dates specified. Dates once notified to the Supplier cannot be changed.
      11. (xi) The prize winner and their party (where applicable) are responsible for and must comply with any health advice / regulations / inoculations required by any destination country. Any associated costs for this are the responsibility of the prize winner and their party (where applicable).
      12. (xii) Northern Lights are a natural phenomenon and neither the Promoter nor the Supplier guarantee that they will be visible at the time of the trip.
      13. (xiii) The prize is supplied by Cloud Nine Incentives, The Station, 7 High St, Olney MK46 4EB (Supplier). The Promoter reserves the right to replace the prize with an alternative prize of equal or higher value if circumstances beyond the Promoter's control makes it necessary to do so.
  40. 4.15 The prizes will be delivered as confirmed by the Promoter at the time the National Champions are informed of their win.
  41. OTHER GENERAL CONDITIONS APPLICABLE TO THE REGIONAL AND NATIONAL PARTS OF THE COMPETITION
  42. 5 The Promoter must either publish or make available information that indicates that a valid award took place. To comply with this obligation the Promoter will send the store name and Region of the Competition prizes winners and, if applicable copies of their winning entries, to anyone who emails Clarion_jti@clarioncomms.co.uk within one month after the Regional Closing Date and National Closing Date respectively.
  43. 6 If you object to any or all of your surname, county and winning entry being published or made available, please contact the Promoter at Clarion_jti@clarioncomms.co.uk. In such circumstances, the Promoter must still provide the information and winning entries to the Advertising Standards Authority on request.
  44. 6.1 All prizes included in both Regional and National Competitions are subject to availability. There is no cash alternative for the prizes.
  45. 6.2

    The prizes are not negotiable or transferable.


    The Promoter will not accept:


    1. (i) responsibility for competition entries that are lost, mislaid, damaged or delayed in transit, regardless of cause, including, for example, as a result of any postal failure, equipment failure, technical malfunction, systems, satellite, network, server, computer hardware or software failure of any kind; or
    2. (ii) proof of posting or transmission as proof of receipt of entry to the competition.
  46. 6.3 By submitting a Competition entry, you are agreeing to be bound by these terms and conditions.
  47. 6.4

    The Promoter will not accept competition entries that are:


    1. (i) automatically generated by computer;
    2. (ii) completed by third parties or in bulk;
    3. (iii) illegible, have been altered, reconstructed, forged or tampered with;
    4. (iv) photocopies and not originals; or
    5. (v) incomplete.
  48. 6.5 The Promoter reserves all rights to disqualify you if your conduct is contrary to the spirit or intention of the prize competition.

  51. 7. Claiming the prizes
  52. 7.1 Please allow up to 8 weeks from the Regional Announcement Date or National Champion Announcement Date, whichever applies, for delivery of all prizes, with the exception of event/festival tickets, which will be delivered in good time before the event date.
  53. 7.2 The Prizes may not be claimed by a third party on your behalf.
  54. 7.3 The Promoter will make all reasonable efforts to contact both the Regional Winners and National Champions. If they cannot be contacted or are not available, or have not claimed their prize within 28 days of days of the relevant announcement date, the Promoter reserves the right to offer the prize to the next eligible entrant selected from the correct entries that were received before the Closing Date.
  55. 7.4 The Promoter does not accept any responsibility if you are not able to take up the prizes.
  56. 8. Limitation of liability
  57. 8. Insofar as is permitted by law, the Promoter, its agents or distributors will not in any circumstances be responsible or liable to compensate the winner or accept any liability for any loss, damage, personal injury or death occurring as a result of taking up the prize except where it is caused by the negligence of the Promoter, its agents or distributors or that of their employees. Your statutory rights are not affected.
  58. 9. Ownership of competition entries and intellectual property rights
  59. 9.1 All National Competition entries and any accompanying material submitted to the Promoter will become the property of the Promoter on receipt and will not be returned.
  60. 9.2

    By submitting your National Competition entry and any accompanying material, you agree to:


    1. (i) assign to the Promoter all your intellectual property rights with full title guarantee; and
    2. (ii) waive all moral rights,

    in and to your competition entry and otherwise arising in connection with your entry to which you may now or at any time in the future be entitled under the Copyright, Designs and Patents Act 1988 as amended from time to time and under all similar legislation from time to time in force anywhere in the world.

  61. 9.3 You agree that the Promoter may, but is not required to, make your entry available on JTI Advance and any other media, whether now known or invented in the future, and in connection with any publicity of the competition. You agree to grant the Promoter a non- exclusive, worldwide, irrevocable licence, for the full period of any intellectual property rights in the competition entry and any accompanying materials, to use, display, publish, transmit, copy, edit, alter, store, re-format and sub-licence the competition entry and any accompanying materials for such purposes.
  62. 10. Ownership of competition entries and intellectual property rights
  63. 10.1 The Promoter will only process your personal information as set out in the https://www.jtiadvance.co.uk/article/privacy-policy . See also conditions 3.6 and 4.5 with regard to the announcement of winners.
  64. 11. General
  65. 11.1 If there is any reason to believe that there has been a breach of these terms and conditions, the Promoter may, at its sole discretion, reserve the right to exclude you from participating in the competition.
  66. 11.2 The Promoter reserves the right to hold void, suspend, cancel, or amend the prize competition where it becomes necessary to do so.
  67. 11.3 Any tax liability arising as a result of the Competition and/or the Prizes is the responsibility of the Qualifying Store owner.
  68. 11.4 These terms and conditions shall be governed by English law, and the parties submit to the non-exclusive jurisdiction of the courts of England and Wales.
